If the merchandise is returned to us by the purchaser within the 90-day warranty period, Wag-Aero may opt to repair or replace any defective merchandise. Merchandise that fails to conform to this Warranty will be repaired or replaced, at Wag-Aero’s option, without charge for parts and labor. Wag- Aero agrees to pay only for parts and labor, or replacements, and return postage by the most economical method. All other expenses are to be paid by the purchaser. Further, Wag-Aero may, at its option, satisfy its obligation under this Warranty by a refund of the purchase price. Wag-Aero’s obligation under this warranty is strictly and exclusively limited to the repair or replacement and return of merchandise that fails to conform to this Warranty, or to a refund of the purchase price, and Wag-Aero assumes no responsibility for any other expenses or damages, including incidental and consequential damages. Some states do not allow the exclusion or limitation of consequential damages, so the above limitation or exclusion may not apply to you. The duration of all implied warranties, if any, is limited to 90-days from the date of purchase. Accordingly, any such implied warranties, including merchantability, fitness for a particular purpose, or otherwise, are disclaimed in their entirety after the 90-day warranty period. Some states do not allow limitation on how long an implied warranty lasts, so the above limitation may not apply to you. To obtain warranty service or a refund if Wag-Aero so elects, please call our Customer Service number to obtain a Return Merchandise Authorization Number (RMA#) along with instructions as to how and where to return the merchandise. Said merchandise must be received by Wag-Aero, postage prepaid, no later than 100 days after purchase. The defective merchandise must be accompanied by the name of the purchaser, proof of purchase from Wag-Aero, and a written statement that identifies the defect. STATE SALES TAX COLLECTION As a direct result of the Supreme Court ruling in South Dakota v. Wayfair dated 6/21/2018, states have been given broader authority to enforce sales tax collection requirements on businesses. Wag-Aero is now required to collect sales tax in certain states, but not all states. If your state requires Wag-Aero to collect sales tax, we will calculate that tax as it applies to goods, services and/or shipping costs, and add it to your invoice. The tax rate used to calculate the tax will be the rate posted by your respective state or the state where the goods are being shipped, if different from your billing address. Shipping costs for phone orders are actual charges plus a $3.00 handling fee per order. Canadian and International Orders: We welcome Canadian and International orders! All orders must include full remittance plus shipping charges payable in US currency. We recommend using Visa, MasterCard, or Discover. We use UPS, FED-EX, or Air Parcel Post for most International shipments. Shipping charges for all International orders are calculated individually for each order. Please include a fax, phone number, or e-mail address so we can send you a quote on shipping. The customer is responsible for any duty, customs, or taxes charged by their country. If Form 8130 (Exporter Certificate of Airworthiness) is required, please indicate at the time of ordering. The fee for issuing a Certificate of Airworthiness is $80.00 . Form 8130-3 (Exporter Certificate of Airworthiness) Form 8130-3 is available on FAA approved products at a cost of $80.00 per order to secure these forms. Please specify the part or parts you want the Form 8130-3 on, as this form cannot be furnished after you receive the product. Expect a slight shipping delay if a Form 8130-3 is requested. ◆ BACK ORDERS: Although Wag-Aero maintains a large inventory, a situation may arise where an item is not immediately available from stock. This would result in a back order on your shipment and merchandise will be shipped as soon as it arrives at our facility. Back ordered items will not be billed until shipped. If this is not desirable, please request “no back orders” when placing your order, and for those infrequent times when an item is not available from stock, your order for that item will be cancelled. ◆ RETURNS: When returning merchandise, prior to sending the product, please call our Customer Service number to obtain a Return Merchandise Authorization Number (RMA#) along with instructions as to how and where to return the merchandise. ◆ DAMAGED OR DEFECTIVE ITEMS: If you receive a damaged, defective or incorrect item, contact customer service no later than 5 business days after you receive the item. Return item with original packaging via common carrier that provides package tracking. If there is extensive damage to the carton, refuse the order and contact customer service immediately. Please have your order number available when you contact customer service. ◆ CUTTING CHARGE: Certain orders for cut materials (i.e., wood, metal) may incur an additional cutting charge of $5.00 minimum. Nearly all of our cut material orders are shipped with no additional charges, however, should your order warrant a cutting charge, you will be contacted with an explanation and request for approval. If approved, we will proceed with the order. Orders must be prepaid. All tubing and sheet material orders are noncancellable and nonreturnable. ◆ RETAIL STORE HOURS: Our Retail Store is open 8:30 am. to 4:30 pm. weekdays. We are located 1/4 mile north of Highway 36 at 1216 North Road in Lyons, WI. Also at this location, we have our own private turf airstrip, 2600 ft. East-West and 2100 ft. Fly in customers should see the Chicago Sectional Map. ◆ DELIVERY (Standard Ground Delivery) Most orders are shipped UPS Ground and require a street address and a daytime phone number, unless it is more economical to ship USPS. Delivery of items in stock normally takes three to five business days. Shipping costs for orders are calculated using actual UPS shipping charges plus a $3.00 handling fee per order. Please note the maximum weight per package for UPS destinations is 150 lbs.. Maximum size is 165” length and girth combined (once down and once around the package). ¨ Oversize designations are given for packages with combined length and girth exceeding 84” (and less than 30 lbs.) and also 108” (and less than 70 lbs.). There are additional charges for Oversize packages. UPS also charges a $14.25 handling fee for packages measuring over 48” in length. Propellers typically incur the $14.25 handling fee. (Express Delivery) We offer Express Delivery Services via UPS or FED-EX. The options available include Next-Day Air, 2nd Day Air, or 3rd Day. The cost of Express deliveries is the total of the actual UPS or FED-EX shipping charges plus $12.50 handling fee for Next Day Air, 2nd Day Air, or 3rd Day. Depending on the size of the package and its destination, Express delivery charges can cost from two to four times more than standard UPS Ground deliveries. Shipping costs for orders are calculated using actual shipping charges plus a $3.00 handling fee per order. Freight charges can vary significantly depending on the actual package size, weight and destination. This information is only known when the order is complete and ready to ship. Our Customer Service Department has no way to accurately estimate freight charges at the time the order is placed. When requested, our Customer Service staff will gladly phone or email the actual shipping costs to you, prior to our shipping of your order. All prices are FOB Lyons, WI and the customer is responsible for actual freight charges as billed on the invoice or shipped freight collect. Actual shipping charges are determined by the shipping company (UPS, USPS or Truck) based on package size, weight, and destination. Shipping charges can be high on oversize, heavy or hazardous goods as well as orders shipped by air. We are happy to provide you with a quote prior to shipping. Please let us know how and where to contact you with special shipping information. ◆ TRUCK SHIPMENTS: Items too heavy or too large for standard ground shipment will be shipped by truck. If a shipment exceeds 80 lbs., truck shipment is likely more economical. Due to heavy-duty boxing and crating there is a $20.00 handling fee. The cost of a truck shipment is determined by type of goods, weight, dimensions, and distance traveled. Truck shipments are insured for full value and should be inspected immediately upon arrival. The freight bill should include customer notes on any damage so that a claim for loss can be filed immediately. Sorry, no C.O.D. shipments for truck delivery. HAZARDOUS MATERIALS: Hazardous materials such as 5 gallon buckets of paint and dopes, etc. require special packaging and documentation. The hazardous materials charge for these items is $35.00 per package. Look for this symbol ▲ designating a hazardous material. ◆ METHOD OF PAYMENT: Credit Card Policy  We gladly accept Visa, Master Card or Discover. In order to prevent credit card fraud, orders for first time customers must ship to the same address as the billing address on the credit card used for the order. The ship to address must match exactly to the address on the credit card. We also reserve the right to ship regular orders only to the address on the credit card account. Other Payment Methods  We also accept Paypal for certain orders, when the ship to address is a PayPal confirmed address. Please FAX or email a copy of your Bank wire transfer along with your order to provide confirmation of funds sent. Orders may be shipped C.O.D. via UPS within the United States ONLY.
